A Constitution Bench headed by CJI B.R. Gavai is hearing the Presidential Reference from August 19, 2025. The hearing opened with Kerala and Tamil Nadu raising preliminary objections to its maintainability, arguing that the questions referred by the President are no longer res integra or unsettled questions of law.
In a brief hearing on July 29, 2025, a five-Judge Bench headed by CJI Gavai asked the Centre and States to file their written submissions by August 12.
